If you initiate a chargeback with your credit card provider without first contacting us to resolve the issue, we reserve the right to dispute such chargeback and to suspend or terminate your account pending resolution. Fraudulent chargebacks may be reported to relevant authorities.

- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES;
- PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE;
- UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA;
- LOSSES RESULTING FROM THIRD-PARTY CONDUCT ON OR THROUGH OUR PLATFORM;
ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, OUR SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN JURISDICTIONS WHERE LIMITATIONS ON LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES ARE NOT PERMITTED, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO 4 RIVERS IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).
9. Indemnification
You agree to defend, indemnify, and hold harmless 4 Rivers and its respective officers, directors, employees, contractors, agents, licensors, service providers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms of Service;
- Your use or misuse of the Site or our services;
- Your violation of any applicable federal, state, or local laws or regulations;
- Your violation of any third-party rights, including intellectual property rights or privacy rights;
- Any content or information you submit, post, or transmit through our Site;
- Any fraudulent, negligent, or intentionally wrongful conduct on your part;
- Any dispute or claim arising from your interactions with other users or third parties through our Site.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense of such claims.
10. Governing Law and Jurisdiction

We operate in compliance with applicable United States federal law, including the Federal Trade Commission Act (FTC Act), which prohibits unfair or deceptive acts or practices in or affecting commerce, as well as applicable food safety regulations administered by the Food and Drug Administration (FDA) and the United States Department of Agriculture (USDA).
11. Dispute Resolution
11.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to contact us in good faith at [email protected] to attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms or our services. We will attempt to resolve your concern within thirty (30) days of receiving your written notice. Many concerns can be resolved quickly and amicably through this informal process.
11.2 Binding Arbitration
If we are unable to resolve your dispute through informal means within thirty (30) days, you and 4 Rivers agree that any dispute, claim, or controversy arising out of or relating to these Terms, the breach thereof, or your use of our services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, rather than in court, except as expressly provided in Section 11.4 below.
The arbitration shall be conducted in the English language. The arbitrator shall have the authority to award any remedy that would be available in a court of law, but the arbitration shall be conducted on an individual basis and not as a class action, collective action, or representative action.
11.3 Class Action Waiver
YOU AND 4 RIVERS AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. FURTHER, UNLESS BOTH YOU AND 4 RIVERS AGREE OTHERWISE, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDER OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.
11.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of that party's intellectual property rights, proprietary rights, or confidential information. Claims that are within the jurisdiction of small claims court may also be brought in small claims court rather than through arbitration.
11.5 Arbitration Fees
Payment of arbitration fees shall be governed by the AAA's Consumer Arbitration Rules. If you are unable to afford the applicable filing fees, you may request a fee waiver from the AAA.
12. Term and Termination
12.1 Duration
These Terms of Service shall remain in full force and effect for as long as you use our Site or services or maintain an account with us, whichever is longer.
12.2 Termination by You
You may terminate your account at any time by contacting us at [email protected] and requesting account deletion. Termination of your account does not affect any obligations you incurred prior to termination, including payment obligations for orders already placed.
12.3 Termination by Us
We reserve the right to suspend or terminate your account, or your access to all or any portion of our Site, at any time and for any reason, including but not limited to:

- Suspected fraudulent, abusive, or illegal activity;
- Failure to pay for services or orders;
- At our sole discretion, with or without cause.

16. Force Majeure
4 Rivers shall not be liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, government-mandated closures or restrictions, supply chain disruptions, labor disputes or strikes, fires, floods, power outages, civil unrest, acts of terrorism, or failures of third-party service providers.
In the event of a force majeure event, we will make reasonable efforts to notify you as soon as practicable and to resume normal operations as quickly as possible. Orders affected by force majeure events will be handled on a case-by-case basis, with refunds or reschedules offered at our discretion.
17. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices or policies posted on our Site, constitute the entire agreement between you and 4 Rivers with respect to your use of the Site and our services. These Terms supersede all prior or contemporaneous agreements, representations, warranties, understandings, or communications, whether oral or written, between you and 4 Rivers relating to the subject matter hereof.

18. Severability
If any provision of these Terms of Service is found by a court of competent jurisdiction, arbitrator, or other adjudicating authority to be invalid, illegal, unenforceable, or contrary to applicable law, that provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the invalid, illegal, or unenforceable provision shall be deemed severed from these Terms.
The invalidity, illegality, or unenforceability of any particular provision shall not affect the validity, legality, or enforceability of any other provision of these Terms, and the remaining provisions shall continue in full force and effect as if the invalid provision had not been included.
The parties acknowledge and agree that the Dispute Resolution provisions contained in Section 11, including the class action waiver, are fundamental to the basis of their bargain, and that without such provisions, the parties would not have entered into this Agreement.
19. Waiver
No waiver by 4 Rivers of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition, or a waiver of any other term or condition. Any failure of 4 Rivers to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
20. Assignment
You may not assign or transfer any of your rights or obligations under these Terms without our prior written consent. We may freely assign or transfer our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law. These Terms shall be binding upon and inure to the benefit of the parties and their respective permitted successors and assigns.
